Privacy Policy

1) Introduction and contact details of the data controller

1.1 We are pleased that you are visiting our website and thank you for your interest. Below, we explain how we handle your personal data when you use our website. Personal data means any information that can be used to identify you personally.

1.2 The controller responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is Hamsterkiste Media GbR, Satingsbaane 3, 49828 Neuenhaus, Germany, Tel.: +491715429169, Email: lernportal@hamsterkiste.de. The controller responsible for processing personal data is the natural or legal person who, alone or jointly with others, determines the purposes and means of processing personal data.

2) Data collection when visiting our website

2.1 When you use our website for information only—that is, if you do not register or otherwise provide us with information—we collect only the data your browser sends to the page server (so-called “server log files”). When you visit our website, we collect the following data, which we need for technical reasons to display the website to you:

  • Our visited website
  • Date and time at the time of access
  • Amount of data sent in bytes
  • Source/referral that brought you to this page
  • Browser used
  • Operating system used
  • IP address used (where applicable, in anonymised form)

Processing is carried out in accordance with Art. 6(1)(f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data is not shared or used for any other purpose. However, we reserve the right to review server log files retrospectively if there are concrete indications of unlawful use.

2.2 For security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or enquiries to the controller), this website uses SSL or TLS encryption. You can identify an encrypted connection by the “https://” at the start of the address and the padlock symbol in your browser bar.

3) Hosting & Content-Delivery-Network

We use a provider to host our website and display its content. The provider delivers its services itself or through selected subcontractors exclusively on servers located within the European Union.

All data collected on our website is processed on these servers.

We have entered into a data processing agreement with the provider to ensure the protection of our website visitors’ data and prevent its unauthorized disclosure to third parties.

4) Cookies

To make visiting our website more appealing and enable the use of certain features, we use cookies, small text files stored on your device. Some cookies are automatically deleted when you close your browser (so-called “session cookies”), while others remain on your device for longer and allow page settings to be saved (so-called “persistent cookies”). In the latter case, you can find out how long they are stored in your web browser’s cookie settings overview.

If personal data is processed through cookies that we use, the processing is carried out in accordance with Art. 6(1)(b) GDPR to perform the contract, in accordance with Art. 6(1)(a) GDPR where consent has been given, or in accordance with Art. 6(1)(f) GDPR to protect our legitimate interests in ensuring the website functions as well as possible and that visits to the site are customer-friendly and effective.

You can configure your browser to notify you when cookies are set and let you decide whether to accept them individually, or to exclude cookies in certain cases or altogether.

Please note that refusing cookies may limit the functionality of our website.

5) Making contact

When you contact us (e.g. via contact form or email), personal data is collected. The data collected when you use a contact form is shown on the relevant form. This data is stored and used solely to respond to your enquiry, contact you and carry out the associated technical administration.

The legal basis for processing this data is our legitimate interest in responding to your enquiry, pursuant to Art. 6(1)(f) GDPR. If you contact us with a view to entering into a contract, the additional legal basis for processing is Art. 6(1)(b) GDPR. Your data will be deleted once your enquiry has been fully dealt with. This is the case when the circumstances show that the matter has been conclusively resolved and provided there are no statutory retention requirements.

6) Use of customer data for direct marketing

6.1 Sign up for our email newsletter

If you sign up for our email newsletter, we will regularly send you information about our offers. Your email address is the only information required to receive the newsletter. Providing any other information is optional and allows us to address you personally. We use the so-called double opt-in procedure to send our newsletter. This means that we will only send you an email newsletter once you have expressly confirmed that you agree to receive it. We will then send you a confirmation email asking you to click a link to confirm that you would like to receive the newsletter in future.

By clicking the confirmation link, you consent to our use of your personal data in accordance with Art. 6(1)(a) GDPR. When you subscribe to the newsletter, we store the IP address entered by your Internet service provider (ISP), as well as the date and time of your subscription, so that we can trace any possible misuse of your email address at a later date. The data we collect when you subscribe to the newsletter is used exclusively to send you promotional content by newsletter. You can unsubscribe at any time using the link provided in the newsletter or by sending a message to the controller named above. Once you unsubscribe, your email address will be removed from our newsletter mailing list immediately, unless you have expressly consented to further use of your data or we have reserved the right to use it for other purposes permitted by law, as explained in this notice.

6.2 Email newsletter distribution to existing customers

If you provided us with your email address when purchasing goods or services, we reserve the right to email you regularly with offers for similar goods or services from our range. Under Section 7(3) of the German Act Against Unfair Competition (UWG), we do not need to obtain your separate consent for this. The data is processed solely on the basis of our legitimate interest in personalized direct marketing, pursuant to Article 6(1)(f) of the GDPR. If you objected to the use of your email address for this purpose at the outset, we will not send you any emails.

You may object at any time, with effect for the future, to the use of your email address for the advertising purpose stated above by notifying the responsible party named at the beginning. You will only incur the standard transmission charges for doing so. Once your objection has been received, use of your email address for advertising purposes will cease immediately.

7) Web analytics services

1&1 IONOS WebAnalytics

This website uses the web analytics service provided by: 1&1 IONOS Internet SE, Elgendorfer Str. 57, 56410 Montabaur, Germany

Using cookies and/or similar technologies (tracking pixels, web beacons, algorithms for reading information from devices and browsers), the service collects and stores pseudonymised visitor data, including information about the device used, such as its IP address and browser information. This data is used for statistical analysis of how visitors use our website and to create pseudonymised usage profiles. This also makes it possible to analyse movement patterns (so-called heatmaps), which show how long visitors stay on pages and how they interact with page content (e.g. text input, scrolling, clicks and mouse-overs). Pseudonymisation generally prevents data from being directly linked to an individual. We do not combine this data with other information that directly identifies you.

All the processing described above, in particular the retrieval or storage of information on the device being used, will only take place if you have given us your explicit consent to do so under Article 6(1)(a) GDPR. You may withdraw your consent at any time, with effect for the future, by disabling this service in the “Cookie Consent Tool” provided on the website.

We have entered into a data processing agreement with the provider to ensure the protection of our website visitors’ data and prevent its unauthorized disclosure to third parties.

8) Page features

8.1 OpenStreetMap

This website uses an online map service provided by: OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, UK

The online mapping service is a tool for displaying interactive maps and visualising geographical information. Using this service allows us to determine your location and makes geolocation easier, if applicable.

As soon as you open pages of our website that include the provider’s map, information about your use of our website (such as your IP address) is transmitted to the provider’s servers and stored there.

Your personal data is processed in accordance with Art. 6(1)(f) GDPR, based on our legitimate interest in designing our website to meet users’ needs. If you do not agree to the future transmission of your data to the provider, you can disable the provider’s online map service entirely by turning off JavaScript in your browser. The online map service on this website can then no longer be used.

Where required by law, we have obtained your consent to the processing of your data described above in accordance with Art. 6(1)(a) GDPR. You may withdraw your consent at any time with effect for the future. To withdraw your consent, please follow the instructions above for exercising your right to object.

When data is transferred to the provider's location, an adequate level of data protection is ensured by an adequacy decision of the European Commission.

9) Rights of the data subject

9.1 The applicable data protection laws grant you the following rights as a data subject in relation to the controller’s processing of your personal data (rights of access and intervention); the legal basis cited below sets out the conditions for exercising each right:

  • Right of access under Article 15 GDPR;
  • Right to rectification under Article 16 GDPR;
  • Right to erasure under Article 17 GDPR;
  • Right to restriction of processing pursuant to Article 18 GDPR;
  • Right to be informed pursuant to Art. 19 GDPR;
  • Right to data portability under Art. 20 GDPR;
  • Right to withdraw consent pursuant to Article 7(3) of the GDPR;
  • Right to lodge a complaint under Article 77 of the GDPR.

9.2 RIGHT TO OBJECT

WHEN WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST AS PART OF A BALANCING OF INTERESTS, YOU HAVE THE RIGHT TO OBJECT TO THIS PROCESSING AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, WITH EFFECT FOR THE FUTURE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, WE MAY CONTINUE PROCESSING IT IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR DOING SO THAT OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING IS NECESSARY FOR THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING. YOU MAY EXERCISE YOUR RIGHT TO OBJECT AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE RELEVANT DATA FOR DIRECT MARKETING PURPOSES.

10) Retention period for personal data

The retention period for personal data depends on the applicable legal basis, the purpose of processing and—where applicable—also the relevant statutory retention period (e.g. retention periods under commercial and tax law).

Where personal data is processed on the basis of explicit consent pursuant to Art. 6(1)(a) GDPR, the data concerned will be stored until you withdraw your consent.

Where statutory retention periods apply to data processed in connection with contractual or contract-like obligations on the basis of Art. 6(1)(b) GDPR, the data is routinely deleted once the retention periods have expired, provided it is no longer required to perform or arrange a contract and/or we have no legitimate interest in retaining it.

When personal data are processed on the basis of Art. 6(1)(f) GDPR, they will be stored until you exercise your right to object under Art. 21(1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims.

When personal data is processed for direct marketing purposes on the basis of Art. 6(1)(f) GDPR, it is stored until you exercise your right to object under Art. 21(2) GDPR.

Unless otherwise specified in the other information in this notice regarding specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
